10. Warranty

10.1. Redress

If the tour is not executed as laid down in the agreement, participants may demand redress. Club Mistral may refuse such redress, if it would involve unjustified expense. Club Mistral may also provide redress in the form of an equivalent alternative service.

10.2. Reduction in tour price

The participant may claim an appropriate reduction in the tour price for the duration of failure to perform the tour as laid down in the agreement. The tour price shall be reduced to an extent corresponding to the ratio that would have existed at the time of sale between the value of the tour in defect-free condition and its actual value. The reduction shall not apply if the participant fails to give notice of the defect for reasons for which he/she is responsible.

10.3. Termination of contract

If a tour is considerably impaired as the result of a defect and if Club Mistral does not remedy the situation within a reasonable period of time set by the participant, the latter may terminate the travel agreement within the scope of the statutory provisions; in his own interests and in order to document such action, notice of termination should be made in writing. This also applies, if the participant cannot be reasonably expected to take part in the defective tour for an important reason recognizable for the organizer. The need to set a period within which redress is to be furnished shall apply in all cases except those in which redress is impossible or rejected by the tour organizer or immediate termination of the agreement is justified by the customer's special interest.

The latter owes the tour organizer that part of the tour price arising in connection with the services utilized, to the extent that they were of interest for him.

10.4. Compensation

The participant may claim compensation for non-performance irrespective of any reduction in price or right to termination, unless the tour defect derives from a circumstance for which Club Mistral is not responsible.
